Petitioner Daniel Delgado was charged by information with one count of burglary and one count of grand theft. The state amended the information to allege a prior conviction for involuntary manslaughter. Pursuant to a plea agreement petitioner entered a plea of guilty to second degree burglary with the prior involuntary manslaughter conviction.
