Harold MacKenzie, a truck driver employed by H. Tabenken & Company, Inc. (Tabenken), petitioned the Industrial Accident Commission for award of compensation on November 20, 1976. In his petition, he alleged that on September 15, 1976, he received a personal injury arising out of and in the course of his employment.
