This is a suit on a contract wherein plaintiff, a subcontractor contracted to do carpet and flooring work on a construction job in which defendant was the prime contractor on land owned by himself. There was judgment prior to trial granting "partial summary judgment" for the amount of $32,433.11 undisputed by both parties and preserving plaintiff's rights to proceed for an additional $15,385.59.
