Appellant, James Harvey Deason, hereinafter referred to as defendant, was charged with the offense of Murder in the Second Degree, pursuant to 21 O.S.Supp. 1973, § 701, and was tried and convicted in the District Court, Tulsa County, Case No. CRF-76-136.
