KELLY, Judge.
This is an appeal from a conviction in the Circuit Court of the City of St. Louis in a jury tried case wherein the appellant, Melvin Harlston, was found guilty of violating § 121.270 subsection 2 V.A.M.S.—Tampering with a Voting Machine—and was sentenced to be confined in the custody of the Missouri Department of Corrections for a period of five years.
