On May 27, 1976, the respondent, at a meeting open to the public, approved a budget for the school year 1976-1977 totaling $4,520,591. At the annual meeting of the respondent district held on June 15, 1976, the voters of the district defeated the proposed budget. On June 23, 1976, respondent voted, pursuant to law, that a contingency budget of $4,390,920 to pay salaries and contingent expenses, be adopted (Education Law, § 2023).
