ROBERTS, Judge.

This is an appeal from a conviction for aggravated rape. The jury assessed the appellant's punishment at confinement in the Texas Department of Corrections for ninety-nine years.

The appellant contends that the trial judge abused his discretion by refusing to grant the appellant's motion to take depositions, that the prosecutor was impermissibly allowed to continue his final argument after the appellant declined to exercise...
