Peter Bryan Sbabo and Lawrence S. Cockerel appeal separately from the judgment in their joint trial, sentencing each of them to a term of four years upon a jury verdict on a charge of battery in the first degree. Both argue that an incriminating statement by Sbabo should have been excluded from evidence as involuntary, and that the trial court erred in refusing to give jury instructions on the lesser included offenses of battery in the second degree...
