This is a suit for declaratory judgment. Suit was brought by ASARCO, INC., (ASARCO) against Insurance Company of North America (INA) to ascertain the respective parties' rights under a general liability insurance policy and to determine whether or not INA had a duty to defend ASARCO in another action.
