TENNEY, District Judge.

The individual plaintiff longshoreman was injured aboard defendants' vessel, instituted an action to recover for his injuries, and settled his claim against the defendants in the amount of $60,000. After the injury and before settlement, plaintiff was paid a total of $17,152.83 in workmen's compensation and medical benefits by his employer's subrogee, the intervenor Liberty Mutual Insurance Company.
