Order modified by (1) deleting the second, third and fourth decretal paragraphs thereof and (2) deleting from the fifth decretal paragraph thereof the words "as being moot" and substituting therefor the following: "without prejudice to their renewal after the trial of the main action." As so modified, order affirmed, with $50 costs and disbursements payable to plaintiff by Cosmopolitan.
