In November 1977 the wife (appellee-Katherine Gartman) filed for a divorce in the Circuit Court of Jefferson County, Birmingham Division. Following an oral hearing at which both husband and wife presented evidence, Mr. and Mrs. Gartman were divorced on the ground of incompatibility of temperament. The trial court ordered that the parties' three parcels of jointly owned real estate were to be sold and that the proceeds from such sales were to be divided...
