The defendants were charged with two counts of distributing a controlled substance (cocaine), in violation of 21 U.S.C. § 841(a)(1). Following a trial to the court,1 both defendants were found guilty as charged. Finley was sentenced to concurrent terms of 12 years imprisonment and 3 years special parole on each count. Hicks received concurrent terms of 4 years...
