On 2 March 1976 the deceased, R. B. Woods, and his wife, the defendant, Ella Woods, lived in their home in Durham County with five children born of the marriage. A family meeting was arranged for the night of 2 March 1976 to discuss family business. The discussion developed into a heated argument with cursing and threats between the deceased and the children.
