AMENDED MEMORANDUM OPINION

GRADY, District Judge.

The plaintiff (insurance company) has brought this action seeking a declaratory judgment that the defendant (widow) is not entitled to receive benefits under an accident insurance policy. The defendant has filed a counterclaim for the policy benefits. Before the court are cross-motions for summary judgment on the declaratory action and the counterclaim.
