Petitioner was a member of the Ithaca Police Department when, on October 16, 1969, he suffered a myocardial infarction. Thereafter, he did not resume his duties with the police force until August 17, 1970, and then approximately two months later, on October 14, 1970, he was admitted to the hospital with unstable angina.
