Robert J. Ryan, a prisoner incarcerated in the United States Penitentiary at Leavenworth, Kansas, appeals the district court's denial of his § 2255 motion to vacate sentence. In his motion, Ryan stated that he was entitled to relief under this court's decision in Kortness v. United States, 514 F.2d 167 (8th Cir. 1975).
