BISSETT, Justice.

This is a suit to recover benefits under an accident policy of insurance. Cue Dee Squyres sued Colonial Life & Accident Insurance Company to recover both accrued and unaccrued monthly payments for the full eleven-year term of the policy, plus attorney's fees, court costs and the 12% statutory penalty.
