Mr. JUSTICE McGLOON delivered the opinion of the court:

Eugene Horton and George Horton, petitioners, were each found guilty at a jury trial of the offense of murder in violation of section 9-1 of the Criminal Code of 1961 (Ill. Rev. stat. 1969, ch. 38, par. 9-1). Each was sentenced to a term of 100 to 150 years in the penitentiary. After these judgments were affirmed on direct appeal to this court in People v. Horton (1973),
