Defendant was found guilty by a district court jury of a charge of felonious theft (theft of property over $100 in retail market value), Minn.St. 609.52, subd. 2(1) and subd. 3(2), and was sentenced by the trial court to a maximum term of 5 years in prison with the sentence stayed on condition that defendant serve a term of 1 year in the workhouse (which term expired in June 1976).
