On April 16, 1974 indictment 74 Cr. 421 was filed charging Benjamin Rodriguez with attempted income tax evasion and filing a materially false income tax return for the year 1967. After a trial on this indictment before Judge Carter, on March 2, 1976, Rodriguez was found guilty on both counts; on April 6, 1976, he received a two year sentence of imprisonment.
