During the trial of this tax assessment review proceeding, appellants attempted to offer the testimony of their expert in rebuttal to the expert testimony adduced by petitioner. This testimony was based upon an "engineering report" prepared by the expert which was not filed and exchanged with petitioners pursuant to the rules of this court (22 NYCRR 678.1).
