Defendant was charged in separate counts of a county attorney's information with the crimes of burglary with aggravation in violation of § 708.2, The Code, and with assault with intent to commit rape in violation of § 698.4, The Code. Upon his plea of not guilty he was tried and convicted by a jury on both counts.
