On April 21, 1976, appellant Gerald Max Ryan was convicted of murder in the first degree. This was the second trial of the case, the first having resulted in a mistrial after the jury was unable to reach a verdict. Appellant was charged with being an "accessory before the fact by counseling, hiring or otherwise procuring an offense to be committed." 13 V.S.A. § 4.
