In an information filed in the District Court for Douglas County on August 19, 1976, Roosevelt Partee, the defendant and appellant herein, was charged with murder in the second degree under section 28-402, R.R.S.1943. Defendant pled not guilty and not guilty by reason of insanity. Trial commenced on November 15, 1976, and a jury found the defendant guilty as charged.
