This is an action to recover damages for personal injuries suffered by plaintiff Gregory J. Duchene, hereinafter plaintiff, when, as a pedestrian, he was struck by a motor vehicle operated by defendant, Barry Wolstan. The case was tried before a jury which found both parties causally negligent and apportioned 5 percent of the causation to plaintiff and 95 percent to defendant.
