The three counts of the indictment charged that on January 10, 1974 appellant and one Vasquez sold a packet of cocaine to an undercover officer in Apartment 2C at 204 West 96th Street in Manhattan; that prior thereto they possessed the packet with intent to sell it; and, that they actually possessed the packet of cocaine.
