Appellant, Raymond Edward Smith, hereinafter referred to as defendant, was charged, tried before a jury, and convicted in the District Court, Oklahoma County, Case No. CRF-76-381, of the offense of Harboring a Criminal, After Former Conviction of a Felony, in violation of 21 O.S. 1971, § 440.
