BRAUCHER, J.

The defendant was convicted in June, 1970, of murder in the first degree, with a recommendation by the jury that the death sentence not be imposed. He appealed under G.L.c. 278, §§ 33A-33G, but the appeal was stayed pending disposition of a motion for a new trial. The motion was denied in September, 1975. We affirm the conviction and decline to disturb the verdict under § 33E.
