ORTH, J., delivered the opinion of the Court.

This appeal concerns a checking account and the mutual rights and liabilities of the bank and its depositor which arise from it. As the circumstances are such that provisions of the Uniform Commercial Code1 on the subject are inapplicable we look to the common law. At stake is almost a quarter of a million dollars paid by the bank and charged against funds standing to the credit of the depositor...
