MEMORANDUM AND ORDER

HANNUM, District Judge.

Presently before the Court is defendant's motion for summary judgment asserting the bar of the statute of limitations with respect to plaintiff's federal securities law cause of action. Since there is no diversity of citizenship between the parties, if defendant's motion is granted, plaintiff's pendant state law claims must also be dismissed. United Mine Workers v. Gibbs, 383 U.S. 715
