PER CURIAM.

Defendant was charged with breaking and entering with intent to commit larceny. MCLA 750.110; MSA 28.305. He was twice tried by jury. The first jury was unable to reach a verdict and was discharged. The second jury found the defendant guilty as charged. After conviction the court placed defendant on probation for a period of three years.

At issue in both trials was the identity of the perpetrator...
