This action was brought under 42 U.S.C. § 1983 for damages arising out of an incident at the McLaughlin, South Dakota police station on November 3, 1973. The plaintiff Delores Taken Alive, an Indian woman, sued Melvin Litzau, a city police officer, for injuries caused by Litzau during the course of what Litzau claimed was an arrest.
