BLISS, Judge:

The Appellant, Harvey Olin Young, hereinafter referred to as the defendant, was charged, tried before a jury and convicted in the Municipal Court of the City of Tulsa, Case No. 210640 B, of the crime of Assault and Battery Upon a Police Officer.
