HOLOHAN, Justice.

The appellant, Phillip Carter, was found guilty by a jury of unlawful possession of marijuana and unlawful possession of a narcotic drug on June 18, 1975. The jury also found the allegation of a prior conviction to be true. On July 11, 1975 appellant was placed on five years' probation on each of the charges.
