Appellants, William Gene Brooks, Joe Brooks and Jim Brooks, hereinafter referred to as defendants, were charged in the District Court of Kiowa County, Case No. CRM-75-222, with the crime of Assault and Battery Upon a Police Officer in violation of 21 O.S. 1971, § 649.
