Ronald D. Conklin filed two motions for declaratory judgment against James Dickerson and American Commercial Insurance Agency, Inc. In one motion he alleged that on or about November 9, 1973, Dickerson and Conklin entered into an agreement whereby Dickerson and his agency would obtain insurance for Conklin's cars, effective immediately, but had negligently failed to obtain the insurance.
