Facts

This case concerns a collision between plaintiff and a tree.

Plaintiff sustained serious and permanent injuries at approximately 11:20 p.m. on July 27, 1973, while operating a motorcycle in a northerly direction on Twelfth Street in a rural section of the City of Portage. Twelfth Street is a north-south street designated as a county road and is under the jurisdiction of the Kalamazoo County Road Commission.
