This appeal follows a bench trial in the circuit court of McLean County in which the defendant was found guilty of unlawful delivery of a controlled substance in violation of section 401 of the Illinois Controlled Substances Act (Ill. Rev. Stat. 1973, ch. 56 1/2, par. 1401(d)). He was thereafter sentenced to a term of imprisonment of 1 2/3 to 5 years as a Class 3 felony. This term was...
