Following a jury trial, Michael Toliver (petitioner), was found guilty of the offenses of murder and attempt robbery (Ill. Rev. Stat. 1967, ch. 38, pars. 9-1, 8-4). He was sentenced to 20 to 30 years imprisonment on the murder conviction and 5 to 8 years on the attempt robbery conviction, the sentences to run concurrently.
