MALETZ, Judge:

In this civil action plaintiff challenges the legality of special dumping duties that were assessed under the Antidumping Act of 1921, as amended (19 U.S.C. § 160 et seq.) against certain asbestos cement pipe which was imported from Japan in March 1972.1 In making this challenge, plaintiff's complaint contains two causes of action, the first of which is the only one relevant to the present motions.
