On April 7, 1975, the defendant pled guilty to a charge of carrying a concealed weapon, MCLA 750.227; MSA 28.424, and was sentenced to a prison term of 40 months to 5 years. The plea agreement provided that the defendant did not waive his right to appeal the trial judge's denial of his earlier motion to suppress the gun found in his automobile when he was arrested.
