K & K Company of Clearwater, Inc. (K & K), a general contractor, required cast iron pipe to be used from time to time in its construction projects in Florida. It bought pipe from McWane Cast Iron Pipe Company in Birmingham (McWane). On January 10, 1972, Jerry Agent, K & K's employee, was sent to McWane in K & K's truck to pick up a load of pipe.
