This matter is before the Court upon defendant's motion for summary judgment.

This is an action based upon Title VII of the Civil Rights Act of 1964, 42 U.S.C. § 2000e et seq. This motion raises an issue as to whether filing requirements imposed by Title VII can be "tolled" by the institution of grievance procedures under a union contract.
