On February 28, 1972, at approximately 11:30 p.m., plaintiff Charles Roy Cole was proceeding eastbound on 23 Mile Road, a two-lane asphalt road, in Shelby Township when he was involved in an automobile accident with a car driven by Charles Tripp which was proceeding in a westerly direction on 23 Mile Road fleeing from the police.

As a result of the accident, plaintiffs Charles Roy Cole and Mary Cole, his wife, filed a complaint against defendant...
