Plaintiff, Edgardo Serpas Martinez, filed the instant suit pursuant to 42 U.S.C. § 2000e, et seq. and 42 U.S.C. § 1981 alleging that his former employer, Hazelton Research Animals, Inc., discriminated against him "because of his ethnic and racial background." The plaintiff is an Hispanic male. The defendant has moved to dismiss on the ground that the plaintiff has not set forth a claim under 42 U.S.C. § 1981...
