Callahan Brothers appeal the order denying it extraordinary costs and expenses under Code of Civil Procedure section 1249.3 which were incurred when it went to trial on the issue of valuation of property condemned by the State of California.

Section 1249.3 reads:

"At least 30 days prior to the date of trial, plaintiff shall file with the court...
