Plaintiffs appeal from an order granting summary judgment under GCR 1963, 117.2(1) for failure to state a claim upon which relief can be granted. We reverse.

Plaintiff Robert Louis Lompre first brought a wrongful death action against defendants in March, 1974. The trial court granted summary judgment for defendants and this Court affirmed, Lompre v Venetjoki, 63 Mich.App. 265;
