After a trial without a jury defendant was found guilty in district court of charges of possessing marijuana in violation of Minn.St. 152.09, subd. 1(2), and of possessing marijuana with intent to sell in violation of Minn.St. 152.09, subd. 1(1). The trial court sentenced defendant on the latter offense to a maximum term of 5 years in prison but stayed execution of sentence pending defendant's appeal.
