This is an appeal from a judgment of the district court affirming an arbitrator's award. We reverse and remand.

On September 16, 1968, Kenneth R. Garber (appellant) entered into a contract with James L. Firmin (appellee) whereby the latter was to prepare plans and specifications for the construction of a residence.
